I would say that given right now is prime baby bird season, that it is in-use.
We have outdoor speakers mounted on our patio ceiling and their is a cute little family of newborn finches or swallows living there. It is amazing to watch and listen to them mature. I cannot get up close enough to take a picture, or I would post as well.

I just took ornithology this semester. I would say in progress. Many birds will build a few nests at the start of spring and make a choice on the best one. Females are finickey. Also I don't think a nest from last summer could have made it through ALL the snow you had this winter.

Take a few pictures if you see it occupied later on.

My guess is a nest in progress too. I do a fair amount of ornithology, amateur, of course, and I would doubt that partial nest could have wintered there in such good condition. After a season of eggs, babies, food, and poop, they're usually pretty ratty and probably wouldn't have survived the winter you've had. It probably wouldn't have survived the San Diego winter this year; it was really wet -- well, relatively speaking.

someone who knows the word 'orinthology' and uses it in a sentence even, could probably hazzard a guess, even a definative one at that....

We had a mama bird build in our wreath on the front door this year!
It was awesome for the kids (and us).. We couldn't use the front door for over a month, but we got to see the building, the eggs, the babies and Sunday morning we saw her shuffling them all around the yard in an intense educational lesson. Now they're gone - so sad..

According to my grandmother, most birds start 2 or 3 nests before they settle on the best location - maybe this was a discard?

i would have to say nest in progress. but i have no expertise on the matter either. it looks a little small to be in use. nice shot.

also, hooray for no more snow. i was grumbling this morning about the cold, 55 degree rain we're having in the northeast and then I watched the clip below. no more grumbling from me.
